Question 09 of 10

How long can they hold me in detention?

There is no single time limit for immigration detention. If a person accepts removal and does not appeal, detention is often shorter and may last several weeks to a few months. If a person appeals a removal order or files motions, detention can last much longer while the case is pending. In situations where a country will not accept a person back, prolonged detention can raise constitutional issues, and detention is often closely reviewed after about six months.
