Can I stay silent?

Yes. During an ICE encounter, individuals generally have the right to remain silent. Choosing to remain silent does not, by itself, prevent ICE from detaining a person. ICE may still take a person into custody to determine identity and immigration status using fingerprints, records, and prior encounters.
